General Terms and Conditions of KBS – World of Stones

§1 Applicability to Entrepreneurs and Definitions of Terms

(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

A consumer is any natural person who concludes a legal transaction for purposes that predominantly are outside their trade, business, or profession (§ 13 BGB).

§2 Formation of a Contract, Storage of the Contract Text

(1) The following provisions on the conclusion of a contract apply to orders placed via our online shop https://www.kbs-shop.com .

(2) In the event of the conclusion of a contract, the contract is concluded with

comes into effect.

(3) The presentation of goods in our online shop does not constitute a legally binding contractual offer on our part, but is merely a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.

(4) When an order is received in our online shop, the following rules apply: The consumer submits a binding contractual offer by successfully completing the ordering procedure provided in our online shop.

The order proceeds in the following steps:

1) Select the desired goods
2) Confirm by clicking the "Order" button
3) Review the information in the shopping cart
4) Click the "proceed to checkout" button
5) Log in to the online shop after registration and entering the login details (email address and password).
6) Review and, if necessary, correct the data entered.
7) Submit the order bindingly by clicking the "place order with obligation to pay" or "buy" button

Before submitting the order bindingly, the consumer can, after checking their information, return to the web page on which the customer's details are recorded and correct input errors by pressing the "Back" button in the internet browser they are using, or cancel the ordering process by closing the internet browser. We confirm receipt of the order immediately by an automatically generated email ("order confirmation"). With this we accept your offer.

(5) Storage of the contract text for orders via our online shop: We store the contract text and send you the order data and our GTC by email. You can view the GTC at any time at https://www.kbs-shop.com/AGB. You can view your past orders in our customer area under My Account -> My Orders.

§3 Prices, Shipping Costs, Payment, Due Date

(1) The stated prices include statutory VAT within the EU and other price components. Any shipping costs are added. For countries outside the EU, additional costs may apply.

(2) The consumer has the option to pay in advance, via PayPal, or by credit card (Visa, Mastercard, American Express).

(3) If the consumer has chosen payment in advance, they undertake to pay the purchase price immediately after conclusion of the contract.

§4 Delivery

(1) Unless clearly stated otherwise in the product description, all items we offer are ready for immediate dispatch. Delivery is made no later than within 3 working days. The delivery period begins, in the case of payment in advance, on the day after the payment order is issued to the bank effecting the transfer, and for all other payment methods on the day after conclusion of the contract. If the end of the period falls on a Saturday, Sunday, or public holiday at the place of delivery, the period ends on the next working day.

(2) The risk of accidental loss and accidental deterioration of the goods sold shall pass to the buyer only upon handover of the goods to the buyer, including in the case of a sale by dispatch.


§4a Undeliverable Shipments / Incorrect Address Information

The customer is obliged to provide a complete and correct delivery address when placing the order and to ensure that delivery to the specified address is possible (e.g., full name identification on the mailbox/doorbell).

If delivery cannot be made for reasons attributable to the customer and the shipment is returned to us (e.g., due to an incorrect delivery address, missing name identification, failure to collect after notification, etc.), the customer is in default of acceptance. In this case, we are entitled to deduct theactually incurred additional costs (in particular the return shipping costs charged by the carrier, any original shipping costs already incurred, as well as reasonable processing or handling costs) from the amount to be refunded or to demand reimbursement from the customer.

The consumer's statutory right of withdrawal remains unaffected.


§5 Retention of Title

We retain title to the goods until the purchase price has been paid in full.

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you who is not the carrier have taken possession of the goods.

of your decision to withdraw from this contract by means of an unequivocal declaration (e.g., a letter sent by post, fax, or email). You may use the attached model withdrawal form, which is not mandatory.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of the additional costs resulting from your choosing a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we receive notice of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earlier.

You must send back or hand over the goods to us without undue delay and in any event not later than fourteen days from the day on which you inform us of your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.

§8 Warranty

Only German is available as the contract language.

 

§9 Notes on the Disposal of Batteries and Rechargeable Batteries in Accordance with §18 BattG

 


In connection with the sale of batteries or rechargeable batteries, we as a retailer are obliged under §18 of the Batteries Act (BattG) to inform our customers of the following:


Spent batteries and rechargeable batteries must not be disposed of with household waste. Consumers are legally obliged to return used batteries and rechargeable batteries to an appropriate collection point or to retailers. You may also return batteries and rechargeable batteries to us free of charge after use.


Batteries and rechargeable batteries that contain harmful substances are marked with the symbol of a crossed-out wheelie bin and one of the chemical symbols:

 

  • Pb = battery contains lead

  • Cd = battery contains cadmium

  • Hg = battery contains mercury

 


Please observe these notes on environmentally responsible disposal.

Alternative dispute resolution pursuant to Art. 14(1) ODR Regulation and § 36 VSBG:

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
